DMCA Policy for NBA Times

NBA Times (“we”, “us”, “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy toward copyright infringement. We reserve the right to block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members, or users and terminate repeat infringers’ accounts.

This policy is intended to guide copyright owners in utilizing the DMCA’s notification and takedown process and to guide users of nbatimes.co.uk on how to respond to such notices.

1. Procedure for Reporting Copyright Infringement

If you believe that material or content residing on or accessible through the NBA Times website (nbatimes.co.uk) infringes your copyright, please send a notice of copyright infringement containing the following information to our Designated Agent listed below:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
  2. Identification of the copyrighted work or works claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including information regarding the location of the infringing materials on the NBA Times website that the copyright owner seeks to have removed, with sufficient detail so that we are capable of finding and verifying its existence.
  4. Contact information of the notifying party, including address, telephone number, and, if available, email address.
  5. A statement that the notifying party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement made under penalty of perjury that the information provided in the notification is accurate, and that the notifying party is authorized to make the complaint on behalf of the copyright owner.

Once our Designated Agent receives a proper, bona fide infringement notification, it is our policy to:

  • Remove or disable access to the infringing material.
  • Notify the content provider, member, or user that we have removed or disabled access to the material.
  • Terminate the accounts of repeat infringers.

2. Counter-Notification Procedure

If you believe that the material that was removed or to which access was disabled is not infringing, or if you believe you have the right to post and use such material from the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send a counter-notification containing the following information to our Designated Agent:

  1. A physical or electronic signature of the content provider, member, or user.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement made under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or a misidentification of the material.
  4. Your name, address, telephone number, and, if available, email address.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are located outside the United States, for any judicial district in which NBA Times may be found), and that you will accept service of process from the person who provided the original infringement notification.

If a counter-notification is received by our Designated Agent, NBA Times may send a copy of the counter-notification to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our discretion.

3. Policy Regarding Repeat Infringers

NBA Times takes copyright infringement very seriously. In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
